Terms of Service - Benefore AI

1. Agreement to Terms

By accessing or using Benefore AI services, you agree to be bound by these Terms of Service. If you disagree with any part of the terms, you may not access our services. These terms apply to all visitors, users, and others who access or use our services.

2. Description of Services

Benefore AI provides personalized AI agent development services, including but not limited to: custom AI agent creation, integration with third-party platforms, ongoing maintenance and support, and partner program services. The specific features and capabilities depend on your subscription plan.

3. Subscription and Billing

Our services are provided on a subscription basis. By subscribing, you agree to the following:

Subscriptions are billed monthly in advance
A one-time setup fee equal to one month of subscription is charged upon initial purchase
Prices are in EUR and do not include applicable taxes
You authorize us to charge your payment method for all fees
Subscriptions automatically renew unless cancelled

4. Cancellation and Refunds

You may cancel your subscription at any time. Upon cancellation, your service will continue until the end of the current billing period. Setup fees are non-refundable. Monthly subscription fees are non-refundable for partial months. If you are dissatisfied with our service within the first 14 days, contact us to discuss a potential refund.

5. User Responsibilities

As a user of our services, you agree to:

Provide accurate and complete information during registration and configuration
Maintain the security of your account credentials
Ensure you have the right to connect third-party services and share data with our platform
Use our services in compliance with all applicable laws and regulations
Not use our services for any illegal or unauthorized purpose
Not attempt to reverse engineer, decompile, or otherwise access our source code

6. Intellectual Property

The Benefore AI platform, including all software, designs, and content, is owned by Benefore AI and protected by intellectual property laws. Your subscription grants you a limited, non-exclusive, non-transferable license to use our services. Your data and content remain your property. You grant us a license to use your data solely to provide and improve our services.

7. Service Level and Support

We strive to provide reliable service but do not guarantee 100% uptime. We provide ongoing support and maintenance as part of your subscription. Agent delivery is typically within 48 hours of order completion, though complex configurations may require additional time. We will communicate any delays promptly.

8. Third-Party Integrations

Our services integrate with third-party platforms. We are not responsible for the availability, functionality, or policies of third-party services. You are responsible for complying with the terms of service of any third-party platforms you connect. API changes by third parties may affect service functionality.

9. Partner Program

Partners agree to promote our services ethically and accurately. Commission payments are made monthly for active subscriptions referred through partner links. We reserve the right to terminate partner accounts for violations of these terms or fraudulent activity. Partner license fees are non-refundable.

10. Limitation of Liability

To the maximum extent permitted by law, Benefore AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues. Our total liability for any claim arising from these terms or your use of our services shall not exceed the amount you paid us in the twelve months preceding the claim.

11. Modifications to Terms

We reserve the right to modify these terms at any time. We will provide notice of material changes via email or through our platform. Your continued use of our services after such modifications constitutes acceptance of the updated terms.

12. Governing Law

These terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Benefore AI operates, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of that jurisdiction.
